Digital Millennium Copyright Act (DMCA) Safe Harbor Notice

This page is primarily for the benefit of those who would like to lodge copyright complaints against us. 

Our terms of service explicitly forbid users from violating intellectual property laws, and we actively disable accounts that are discovered to abuse these laws. 

4th-A Technologies, LLC follows the safe harbor provisions of 17 USC. § 512, otherwise known as the Digital Millennium Copyright Act (DMCA). As such, we will respond to written notification of copyright infringements in accordance with the DMCA. If you believe your copyrighted material is being infringed on our service, please contact us immediately. 

Our DMCA Designated Agent Information information is on file at https://dmca.copyright.gov/ 

In order for us to respond, you must provide us notice in a form that substantively complies with the safe harbor provisions of the DMCA. Your notice of claimed infringement must be a written and include ALL of the following: 

  1. A physical or electronic signature of the copyright owner or person authorized to act on behalf of the owner which expressly claims an exclusive right that is allegedly being infringed. 
  2. Specific identification of the copyrighted work which you are alleging to have been infringed. If you are alleging infringement of multiple copyrighted works with a single notification you must submit a representative list which specifically identifies each of the works that you allege are being infringed.
  3. Specific identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material. In addition you should include the "Cloud Name" as displayed in the file info section of the Storm4 application.
  4. Information reasonably sufficient to permit us to contact you such as an address, telephone number, and if available, an electronic mail address at which you may be contacted.
  5. A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent or the law.
  6. A statement that the information in the notification is accurate, and under penalty of perjury that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed. 

Please also note that under applicable law, 17 U.S.C. 512(f), any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability. 

In addition, if you do not provide a written notice that meets these elements, we will not honor your request and are not required by law to do so.
